One gets placed in ProgramData/Microsoft/Windows/Start Menu/Programs
The other gets placed in Appdata/Roaming/Microsoft/Windows/Start Menu/Programs
The top one is for TS3 and the bottom other one is for TS5.
I would guess that you have renamed the one for TS3 as it normally says TS3 in the name.
Because these are different programs they both have their shortcut which gets placed in the windows folders.
Why they are in different locations idk any comes maybe down to the way it was installed or what ever path was used more at the time of development.

No. This happens on a fresh install of TS5, on a fresh Windows. I do not have TS3 installed.
I can confirm this.
It happens because the installation creates a shortcut both in “All Users Start Menu” folder and in “Personnal User Start Menu” folder.
You can safely delete any of those two you don’t want.
